This is rather a unique situation ... I think. You don't often hear about a license expiring. (If another mod has a different opinon, feel free to share it)
I believe that it should be okay for sharing these files as long as it remains unlicensed. More recent examples of this situation are with Xenosaga: The Animation and Tales of Eternia.
Specifically Xenosaga, the license I think was originally by either Bandai or Funimation, so all torrents, links, etc... were removed. However, the license disappeared and animesuki re-hosted it again until it was re-licensed by ADV recently. So, I say until the license reappears, the file should be okay to share.
Regarding DVD in stores, there are probably a limited amount since if the license was dropped, they are not allowed to reproduce any more because they don't hold the rights to it any longer.
